These Terms of Service (the “Terms”) are a binding agreement between you and The operators of is-totally.exposed (“we”, “us”, “our”), the operator of is-totally.exposed and every subdomain of it (the “Site”). They cover everything you do on the Site, whether you post anonymously, browse, or register an account.
Please read them carefully. By entering the Site, clicking “I am 18 or older”, uploading anything, or creating an account, you agree to these Terms, our Privacy Policy and our Content Rules, which are part of these Terms. If you don’t agree, don’t use the Site. Section 17 contains a binding individual arbitration agreement and a class action waiver that affect your rights, unless you opt out or the law where you live doesn’t allow them.
1. Who can use the Site
- You must be at least 18 years old, and old enough to view adult material and to enter a contract where you live, whichever is higher.
- You may not use the Site where viewing or sharing its content is illegal for you, or where the law requires an age or identity check that the Site does not perform. You are responsible for knowing and following the laws that apply to you. We may block access from any place at any time.
- You may not use the Site if we have banned you, or if you are barred from receiving services under the laws of the United States or any other applicable country.
The Site contains nudity and sexually explicit material made and shared by other users. By entering you confirm that you are not offended by such material and that you want to see it.
2. What the Site is
The Site lets people share photos and videos, mostly anonymously, in rooms that can expire after a set time. Registered users get a subdomain and may host rooms on it. Posts can be ranked, liked and shown on public boards.
Rooms and posts are temporary, and nothing on the Site is a backup. Public copies may disappear when a room’s timer ends, when a room’s creator sets them to, after reports, or at any time for any reason. Keep your own copies of anything that matters to you. We may change, suspend or end any part of the Site at any time without notice and without liability to you.
3. Anonymous use and accounts
- If you don’t register, a cookie gives your browser a random handle so cooldowns, likes and rankings work. Anonymous does not mean untraceable: we record IP addresses and other technical data as described in the Privacy Policy and will disclose them when the law requires it.
- If you register, you must keep your password secret and you are responsible for everything done with your account. Tell us through the contact form if you think someone else has used it. One person may hold one account; don’t create accounts to get around a ban, a limit or a cooldown.
- Subdomains. Your username becomes a subdomain of the Site (for example, name.is-totally.exposed). It is a license to use part of our domain, not property you own. You may not sell, transfer or rent it. We may refuse, reclaim, rename or disable any username or subdomain, including ones that impersonate someone, infringe a trademark, mislead, are offensive, or sit unused, and we keep a list of reserved names.
4. Your content
Ownership and license
You keep whatever rights you have in the photos, videos, captions and other material you post (“Your Content”). By posting it, you give us a worldwide, non-exclusive, royalty-free, sublicensable and transferable license to host, store, copy, process, re-encode, resize, crop, strip metadata from, display, distribute, rank and make Your Content available on the Site and in connection with operating, improving, moderating and promoting the Site. The license lasts while Your Content is on the Site and afterwards for as long as we keep a copy under the Privacy Policy, including private copies kept for safety, legal and dispute purposes.
Private originals
When you upload, we keep the original file privately with its GPS and other location data removed, but with its other metadata (such as the camera model and the time it was taken). Other users see only a re-encoded copy with all metadata removed. Only our administrators can access originals, and we use them to investigate abuse, enforce these Terms, answer legal requests and resolve disputes. If you don’t want us to have a file’s metadata, remove it before you upload.
Promises you make about Your Content
Every time you post, you promise that:
- you own Your Content or have every permission needed to post it and to grant the license above;
- every person shown in it was at least 18 years old when it was made, and you can prove it if asked;
- every identifiable person shown in it agreed to being recorded and to it being posted publicly on a site like this one, and has not withdrawn that consent, and you can prove it if asked;
- it does not break the Content Rules, these Terms or any law, and it doesn’t infringe anyone’s copyright, trademark, privacy or publicity rights; and
- it contains no malware or code meant to harm anyone.
You are solely responsible for Your Content and the consequences of posting it. We are not the publisher or speaker of anything users post.
5. Rules of conduct
You must follow the Content Rules. In short: no material involving minors, no intimate images shared without consent, no doxxing, no infringement, nothing illegal. You also agree not to:
- use bots, scrapers or automated tools to access, upload to, like, rank or copy from the Site, except a public search engine following robots.txt;
- manipulate likes, views, rankings or leaderboards, or use several identities to do so;
- get around cooldowns, rate limits, bans, blocks, bot checks or any security or access control;
- probe, scan or test the Site for vulnerabilities, or interfere with or overload it, except under a written agreement with us;
- impersonate anyone, or misrepresent your connection to anyone;
- use the Site to advertise, solicit or sell sex, sexual services or any goods or services, or to recruit anyone into commercial sex; or
- collect information about other users, including trying to identify anonymous users.
6. Hosting rooms
If you create a room or host rooms on your subdomain, you choose its settings, such as how long it lasts, upload cooldowns and when posts are deleted. You must keep your rooms within these Terms. Room settings don’t limit our rights: we may remove posts or rooms, change their settings, or keep copies as these Terms and the Privacy Policy allow, whatever a room’s timer says.
7. Moderation, reports and enforcement
- We don’t review content before it appears and have no duty to monitor the Site, but we may. We can remove, hide, block, limit, rank lower or keep any content, and suspend or ban any identity, account, subdomain, device or IP address, at any time, for any reason or no reason, with or without notice, including when we believe content or conduct breaks these Terms, is harmful, or exposes us or others to legal risk.
- Anyone can report a post with the report button. Some reports hide a post right away while we review it.
- We report apparent child sexual exploitation to the National Center for Missing & Exploited Children (NCMEC) and to other authorities as the law requires, and we preserve the related material and data for them.
- Where the law entitles you to it (for example under the EU Digital Services Act), we will tell you why we removed your content or restricted your account, and you may ask us to review the decision through the contact form. Anonymous users can only be reached if they contact us.
- Our decisions about moderation are final, except where the law gives you a right of appeal or redress.
8. Copyright
We respond to notices of claimed copyright infringement that comply with the U.S. Digital Millennium Copyright Act and similar laws. See Copyright and DMCA for how to send a notice or a counter-notice. Under our repeat infringer policy, any account or anonymous identity that receives 3 valid notices is banned, and we may ban sooner.
9. Our property
Except for Your Content and other users’ content, the Site and everything in it, including its software, design, logos and the name “picsite”, belongs to us or our licensors. We give you a personal, revocable, non-transferable license to use the Site as these Terms allow and for no other purpose. If you send us ideas or feedback, we may use them without paying or crediting you.
10. Other users and third parties
Content on the Site comes from users, not from us. We don’t endorse it, and we aren’t responsible for it or for what users do on or off the Site. You use other users’ content at your own risk. Links to other sites and services we use (such as bot checks) are run by others under their own terms. Disputes between users are between those users.
11. Ending your use
You may stop using the Site at any time, and you may ask us to delete your account through the contact form. We may suspend or end your access at any time under Section 7. When your access ends, the license in Section 4 continues for copies we keep, and Sections 4, 9, 10 and 12 to 19 keep applying.
12. Disclaimers
The Site is provided “as is” and “as available”, with all faults. To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy and quiet enjoyment, and any warranty that the Site will be uninterrupted, secure, error-free or free of harmful material, that content will be kept or deleted at any particular time, or that anonymity will be preserved.
13. Limits on our liability
To the fullest extent the law allows, neither we nor our owners, officers, employees, contractors, moderators, hosting providers or agents will be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, data, goodwill or reputation, or for content posted by anyone other than us, arising from or related to the Site or these Terms, however caused and even if we were told they were possible. Our total liability for all claims arising from or related to the Site or these Terms is limited to the greater of the amount you paid us in the 12 months before the claim (if any) and US$100.
Some places don’t allow some of these limits. Where that’s the case, they apply only as far as the law allows. Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or anything else that can’t be limited by law.
14. Indemnity
You will defend, indemnify and hold harmless us and our owners, officers, employees, contractors, moderators, hosting providers and agents from any claim, demand, loss, liability, damage, fine, cost or expense (including reasonable lawyers’ fees) arising from or related to Your Content, your use of the Site, your breach of these Terms, or your violation of any law or of anyone’s rights. We may take over the defense of any such matter at your expense, and you will cooperate with us.
15. Legal protections for platforms
We act as a hosting provider for material users post. Nothing in these Terms waives any immunity or protection available to us, including under 47 U.S.C. § 230, 17 U.S.C. § 512, and the hosting provisions of the EU Digital Services Act and similar laws. Our choice to moderate or not moderate any content doesn’t make us responsible for it.
16. Governing law and courts
These Terms and any dispute arising from or related to them or the Site are governed by the laws of the Republic of Moldova, without regard to its conflict-of-law rules, and, where applicable, the U.S. Federal Arbitration Act. Subject to Section 17, the courts located in Chișinău, Moldova have exclusive jurisdiction, and you and we consent to them. If you are a consumer living in the European Union, the United Kingdom or another place whose law gives you the right, you also keep the protection of the mandatory laws of where you live and may bring proceedings in your local courts.
17. Arbitration and class action waiver
Talk to us first. Before starting any claim, you agree to send a written description of it through the contact form and give us 60 days to try to resolve it informally.
Binding individual arbitration. Except as listed below, any dispute that isn’t resolved informally will be decided by binding arbitration on an individual basis, administered by the American Arbitration Association under its Consumer Arbitration Rules, by a single arbitrator, and not in court. Either of us may instead bring an individual claim in small claims court, and either of us may go to court to stop infringement or misuse of intellectual property or to stop unauthorized access to the Site.
You and we each waive any right to a jury trial and to bring or take part in any class, collective, consolidated or representative action. The arbitrator may award relief only to the individual party seeking it.
Opting out. You may opt out of this Section 17 by writing to us through the contact form within 30 days of first agreeing to these Terms, choosing “Legal notice or dispute” and including the words “Arbitration opt-out” and your username or handle. This Section doesn’t apply where the law where you live prohibits it.
18. Changes to these Terms
We may change these Terms. We’ll post the new version here with a new effective date and, for material changes, give notice on the Site. Changes apply from the effective date and don’t apply to disputes we already knew about. If you keep using the Site after a change takes effect, you accept the new Terms. If you don’t accept them, stop using the Site.
19. General
- These Terms, with the Privacy Policy, the Content Rules and any policy they link to, are the entire agreement between you and us about the Site.
- If any part of these Terms can’t be enforced, the rest stays in effect and that part is enforced as far as possible.
- If we don’t enforce a right, we haven’t given it up.
- You may not transfer your rights or duties under these Terms. We may transfer ours, including in a sale or reorganization of the Site.
- We aren’t liable for delays or failures caused by events beyond our reasonable control.
- No one other than you and us has rights under these Terms.
- Headings are for convenience only. “Including” means “including without limitation”.
